NOTICE OF CLASS ACTION SETTLEMENT

You have been identified as a potential member of a class.

A federal court authorized this Notice. This is not a solicitation from a lawyer, and you are not being sued.

If you received any telephone calls from HSN, Inc. (“HSN”) that were directed to a number that was assigned to a cellular telephone service, via an automatic telephone dialing system or using an artificial or prerecorded voice, from April 1, 2015 through December 12, 2019, after you told HSN to stop calling you, you may be entitled to compensation as a result of the settlement in the class action lawsuit captioned:

Please read this notice carefully.
It explains your rights and options to participate in a class action settlement.



  • A consumer, Maurice Jewell, Jr., sued HSN alleging that HSN violated the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, and the Wisconsin Consumer Act (“WCA”), Wis. Stat. § 427.101, et seq., when calling consumers on their cellular telephones, via an automatic telephone dialing system, or using an artificial or prerecorded voice, after the consumers asked HSN to stop calling. HSN denies the allegations. The parties have agreed to a settlement.
  • The settlement will provide a total of $700,000 (the “Fund”)—unless there are more than 800 class members—to fully settle and release claims of a class of persons and entities to whom HSN placed, or caused to be placed, one or more calls, directed to a number assigned to a cellular telephone service, by using an automatic telephone dialing system or artificial or prerecorded voice, from April 1, 2015 through December 12, 2019, after HSN, Inc.’s records show that a “Never Call“ Flag was added to that person’s or entity’s account.

    DO NOTHING AND STAY IN THE SETTLEMENT


    If you do nothing, you will receive a payment from the settlement fund, but you will also release claims you may have against HSN related to this case. Payments are expected to be at least $550, depending on the number of Class Members who do not exclude themselves.


    EXCLUDE YOURSELF FROM THE CASE


    If you exclude yourself from the settlement, you will not receive a share of the settlement fund, and you will not release any claims you have against HSN. The deadline for excluding yourself is July 8, 2020.


    OBJECT TO THE SETTLEMENT


    Write to the Court about why you do not believe the settlement is fair, reasonable, and adequate. The deadline for objecting is July 8, 2020.

  • The Court in charge of this case still must decide whether to approve the settlement. Settlement payments will be made if the Court approves the settlement, and after any appeals are resolved. Please be patient.
